Terms and Conditions

Air Care Limited – Air Care & Daikin Systems Warranty 

Effective March 28th, 2015.

“Air Care Ltd”, of Air Care House, 7 Mills Creek Road, Pembroke, HM05, Bermuda, warrants as follows to the original owner of the air conditioning systems supplied that, if purchased from and installed by Air Care Ltd., should prove to be defective by reason of, or against defects arising from improper manufacturer workmanship and/or material:

A. Air Care Air Conditioning Systems (1/5 Standard Warranty) One Year Parts & Labor/Five Year Compressor. The parts and compressor are warranted for a period of one (1) and five (5) years respectively after the date of the original installation by an Air Care Ltd employee, appointed and dispatched by Air Care, at the owner’s premises. Air Care Ltd will provide a replacement for any defective part without charge, excluding charges for charges for shipping, duty and handling at the applicable current rates. Parts and/or compressor may be replaced with those of like kind and quality and may be new or remanufactured. Parts and/or compressor used for replacement are warranted for the remainder of the original warranty period only. Defective parts and/or compressor must be made available to Air Care Ltd. in exchange for their replacement and become the property of Air Care Ltd.

B. Daikin Air Conditioning Systems (1/5/7 Standard Warranty) – One Year Parts & Labor/Five Year Parts Only/Seven Year Compressor Only. One (1) year parts and labor limited warranty. The parts and compressor are warranted for a period of five (5) years and seven (7) years respectively after the date of the original installation by an Air Care Ltd employee, appointed and dispatched by Air Care, at the owner’s premises. Air Care Ltd will provide a replacement for any defective part and/or compressor without charge. All shipping and handling, duty and installation are applicable at the current rates. Parts and/or compressor may be replaced with those of like kind and quality and may be new or remanufactured. Parts and/or compressor used for replacement are warranted for the remainder of the original warranty period only. Defective parts and/or compressor must be made available to Air Care Ltd. in exchange for their replacement and become the property of Air Care Ltd

C. Daikin Air Conditioning Systems (10/10 Extended Warranty) – Ten Year Parts/Ten Year Labor. The parts including compressor and any related repair labor charges are warranted for a period of ten (10) years after the date of the original installation by an Air Care Ltd employee, appointed and dispatched by Air Care, at the owner’s premises. Air Care Ltd will provide a replacement for any defective part and/or compressor without charge, including the labor to complete any repairs during regular working hours. Parts and/or compressor may be replaced with those of like kind and quality and may be new or remanufactured, subject to standard ocean freight when required, and are warranted for the remainder of the original warranty period only.

This 10/10 limited warranty is non-transferable and subject to the following terms and conditions: 

a) The 10/10 Warranty is applicable to Daikin “LV” Series, “Quaternity Series” and the “MXS Multi Split Series” only.

b) Air Care Ltd performs the installation, testing, commissioning of each Daikin System.

c) Air Care Ltd performs one annual service in accordance with Daikin’s preventative maintenance requirements for the entire duration of the warranty period. Each annual service must occur within one year of the date of commissioning, and occur annually thereafter for the entire duration of the warranty period.

d) Anyone performing any preventative maintenance, diagnostic evaluation or repairs, other than a current Air Care employee appointed and dispatched by Air Care to undertake such work, voids the 10/10 warranty.

e) Corrosion/Rust is excluded, and the warranty is applicable only to the parts required for system operation in accordance with the manufacturer’s intended operation.

f) The 10/10 Extended Warranty is applicable to residential installations only as determined by Air Care Ltd.

In the event any Air Care and Daikin Air conditioning systems are not installed by Air Care the warranty is limited to one (1) year, limited to the replacement of defective parts only, excluding labor, shipping and duty, and subject to the verification of correct installation practices as determined by Air Care, without exception. 

D. Timely Notice. To obtain warranty service and parts replacement under any warranty program, you must notify Air Care Ltd of any defect within the applicable warranty time period.

BEFORE REQUESTING SERVICE, please review the Operating Instruction Manual to ensure proper operation and correct customer control adjustment. If the problem persists please arrange for warranty service.

1. TO OBTAIN WARRANTY PARTS SERVICE: a) Contact Air Care Ltd and provide in writing a detailed explanation of the warranty claim. b) Provide a copy of the commissioning report, a copy of the original receipt, and the Air Care performed service history. C) This Limited Warranty applies only while the “Air Care” or “Daikin” product remains at the site of the original installation.

2. THIS LIMITED WARRANTY DOES NOT COVER property damage, malfunction or personal injury caused by or resulting from: [a] accident, abuse, negligence or misuse; [b] operating the “Air Care” or “Daikin” product in a corrosive or wet environment containing chlorine, fluorine or any other chemical hazardous to the product; [c] installation, alteration, repair or service by anyone other than Air Care Ltd or other than pursuant to the manufacturer’s instructions; [d] improper matching of components of the product; [e] improper or deferred maintenance contrary to the manufacturer’s instructions; [f] physical abuse to or misuse of the product (including any failure to carry out any maintenance as described in the Operating Instruction Manual including air filter cleaning or any product damaged by excessive physical or electrical stress); any products that have had a serial number or any part thereof altered, defaced or removed; product use in any manner contrary to the Operating Instruction Manual; freight damage; or any damage caused by force majeure or other factors beyond the reasonable control of Air Care Ltd, such as power surge damage caused by lightning and fluctuations in or interruptions of electrical power and flood.

3. This Limited Warranty also excludes service calls where no defect in the product covered under this warranty is found. Please consult the operating instructions contained in the Operating Instruction Manual furnished with the product for information regarding user controls.

4. YOUR ONLY REMEDIES ARE PROVIDED IN THIS LIMITED WARRANTY. ANY EXPRESS WARRANTY NOT PROVIDED HEREIN, AND ANY REMEDY WHICH, BUT FOR THIS PROVISION, MIGHT ARISE BY IMPLICATION OR OPERATION OF LAW, IS HEREBY EXCLUDED AND DISCLAIMED. THE IMPLIED WARRANTIES OF MERCHANTABILITY AND OF FITNESS FOR ANY PARTICULAR PURPOSE ARE EXPRESSLY LIMITED TO THE TERM SPECIFIED FROM THE ORIGINAL INSTALLATION DATE.

5. UNDER NO CIRCUMSTANCES SHALL AIR CARE LTD BE LIABLE TO THE PURCHASER OR ANY OTHER PERSON FOR ANY INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, WHETHER ARISING OUT OF BREACH OF WARRANTY, BREACH OF CONTRACT, OR OTHERWISE.
